Probates

Probate is the legal process of administering the estate of a deceased person, the process of probate involves resolving any claims and distributing the deceased person’s property under the valid will. Probate interprets the instructions of the deceased, decides the executor as the personal representative of the estate, and adjudicates the interests of heirs and other parties who may have claims against the estate.

When someone dies most estates have to go through probate, whether the deceased has left a will or not. The estate going through probate ensures the deceased estate passes to the right people and all tax due on death is identified and collected.

If your estate is over five thousand pounds, before it can be collected for distribution, a Grant of Probate must be obtained. This means the Will must be formally recognised at the local Probate Registry. Any Banks or Insurance Companies will now insist on seeing a Grant of Probate before any money will be paid out and the house will also not be able to be sold.
